Rules effective from April distinguish permitted self-employment from employing other people.
Indian graduates working in Auckland on a Post-Study Work Visa should check how New Zealand's updated open-work-visa conditions apply to their employment or business arrangements.
Changes took effect on 20 April 2026 following an Immigration New Zealand announcement in February. INZ introduced two types of employment conditions, with different permissions depending on the visa category.
Post-Study Work Visas and Partner of a Student Work Visas are among the categories listed as allowing work for an employer, sole trading, or owning and operating a business. However, a condition applying to all open work visas prohibits employing other people directly or indirectly through a business the holder operates.
Other listed open visa categories require work for an employer under an employment agreement or contract for services. The announcement explicitly states that these changes do not apply to student visa holders.
INZ also describes transitional arrangements for existing holders undertaking certain work that is no longer permitted. Such arrangements should be checked against the person's visa and expiry date rather than assumed to apply indefinitely.
The distinction matters for graduates who are comparing a salaried position with freelance or business work. Permission to operate as a sole trader does not automatically mean permission to build a business that employs staff.
For readers, the practical lesson is to begin with the exact visa category and written conditions before making a work decision. Terms such as 'open visa' are useful descriptions, but they do not explain every restriction.
A student moving into graduate employment should also recognise that student work rights and post-study work conditions are different. The rules attached to one stage of the study-to-work journey should not be carried across to another without checking.
